BOOKING TERMS

Our Agreement: 

By placing an order through Colour You Beautiful whether that be through our website, our social media pages or in our store, you (the renter) agree to all the terms and conditions explained below, this is a legally binding contract between yourself and Colour You Beautiful and should be read prior to placing the hire order.

 

Title to and ownership of rental item(s)

At all times, the rental items are and remain the property of Colour You Beautiful.

Identification:

Due to the value of the items rented through Colour You Beautiful, in some cases you may be required to supply identification in the form of a driving license or passport. If this isn’t provided Colour You Beautiful reserves the right to refuse the booking.

Debit / Credit card information:

By renting an item through Colour You Beautiful you accept this agreement and therefore give permission for Colour You Beautiful to take and store debit or credit card information for the term of the hire. This information will only be stored for the duration of the hire period and will be removed from storage once the item is returned and has been checked for any damages.

Hiring items to minors:

Clients who are under the age of eighteen years must have a parent or guardian read and agree to these terms and conditions prior to hire.

Cleaning:

We know accidents happen, and we will take care of all the small stuff. All of our garments are professionally cleaned when they are returned after each rental and as long as the memory of your rental with us remains a memory and not stained on the garment then no fees will be charged.

Under no circumstance attempt to clean the rental item(s) yourself or have them cleaned by any individual or company.

If an attempt is made to clean the rental items which leads to damage or cause a stain to become permanent, Colour You Beautiful reserves the right to charge a fee of up to 120% of the RRP of the rented item(s).

 

*Please be aware that this also applies to fake tan which may cause staining even when dry-cleaned and the damage policy will apply at the discretion of Colour You Beautiful.*

 

Damage or Loss:

Colour You Beautiful is a hire business and therefore not all items owned by Colour You Beautiful are new and therefore there is no expectation there they are in an unused condition.

Colour You Beautiful is not obligated to offer any cancellation, exchange or refund if items are subject to general and ordinary wear and tear after the client has taken possession of the item.

In the unlikely event that an item arrives damaged (stains, rips, etc.) the customer is obligated to immediately notify Colour You Beautiful with images of the damage included. All items go through a quality check and photos / videos are taken of the items to ensure the highest possible standard before they are sent for delivery.

Customers are to make no changes, alterations (whether permanent or temporary) at any time during the hire period and not for any reason.

We understand that in this business a little wear is expected and we encourage all those renting to enjoy their time with the item(s). However, if an item is damaged do not attempt to repair it yourself, by another individual or company. If the item can be easily repaired (sewing on a button, re-stitching) it will be taken care of at Colour You Beautiful with no additional cost to yourself.

If an item is damaged and it cannot be repaired / cleaned to an “as new” condition (as of the opinion of Colour You Beautiful), the renter of the item will be liable for the cost of restoring or replacing the garment. In the case where the garment cannot be restored to a suitable condition, there may be a charge of up to 120% of the original RRP of the garment. This fee will be on top of any and all amounts already paid for rental or postage, this includes the item(s) return to Colour You Beautiful regardless of the amount of damage.

Where there has been damage to an item(s) subject to a hire period by a customer which are not able to be repaired or replaced prior to an upcoming hire period, the customer is liable for payment of the upcoming hire period, ensuring that the business is not losing income for an upcoming hire period which has already been booked, but can no longer be filled due to the damage or loss of the item.

If you lose or do not return an item you will be liable for up to 200% of the original RRP of the item. This charges will be applicable up until either the item is returned without damage to the business or up until a time in which the business has charged the customer an amount equivalent to 200% Recommended Retail Price (RRP) of the item(s).

Our 3 shipping options:

Pickup:

Orders placed through our website where the shipping method “pickup” is chosen by the customers is usually ready within 2 hours and the pickup location is Shop 2 9-11 Gawler Street, Mount Barker. This option is available at all times on our website however will only be fulfilled during our business hours - Monday 9-12, Tuesday- Friday 9-4 and Saturday 9-1. 

 

Delivery:

Deliveries will be made by Colour You Beautiful employees after our store trading hours - Monday 9-12, Tuesday-Friday 9-4, deliveries are not made on Saturday or Sunday. These deliveries will be made on the first day of your booking period, ie. If you book Friday-Saturday 2 day hire, the delivery will be made after 4pm on the Friday. It is the responsibility of the customer to choose the correct delivery day. 

 

Shipping:

Shipping is done through Auspost Express (1-2 business days), deliveries are aimed to be delivered on the first day of your booking period. It is the responsibility of the customer to choose the correct booking period in order for the deliveries to arrive on time. 

Shipping fee is inclusive of express postage (1-2 business days) and a pre-paid express return satchel for the item to be returned to the store. 

 

Renting and/or borrowing items to third parties:

Item(s) subject to a hire period are to remain the possession of the customer at all times unless there has been a prior agreement reached between the customer and Colour You Beautiful.

 

Extra fees:

Many items available for rent with Colour You Beautiful are sold out in retail stores and are no longer available for purchase, this along with the loss of any potential earnings from future retails is why any charge may exceed the RRP. This fee will be charged on top of any amount that has already been paid for the original hire of the item(s).

By renting an item through Colour You Beautiful you accept this agreement and therefore give permission for Colour You Beautiful to take and store debit or credit card information for the term of the hire. Colour You beautiful has permission to charge fees for damages or loss of any and all items rented, this charge will be made from the original payment method used when placing the rental. This extra fee policy is not intended for the profit of Colour You Beautiful it is to ensure our items remain in a high quality condition.

 

Issues with fit and/or appearance:

If there is any doubt about size, colour or style of any of the items available through Colour You Beautiful please do not hesitate to get in touch for more information. Colour You Beautiful is a store with regular open hours and the opportunity to contact and book for alternative hours, for this reason we take no responsibility if you choose a size or item that does not fit you or does not suit you & therefore cannot offer a refund for this reason. If the Colour You Beautiful studio hours do not work for you please don’t hesitate to get in touch & we will try to accomodate you where it is possible.

 

Rental Period:

2 day rental period includes the day the item is collected from Colour You Beautiful and includes the day the item is returned to Colour You Beautiful.

4 day rental period includes the day the item is collected from Colour You Beautiful, and includes the day the item is returned to Colour You Beautiful.

6 day rental period includes the day the item is collected from Colour You Beautiful, and includes the day the item is returned to Colour You Beautiful.

8 day rental period includes the day the item is collected from Colour You Beautiful, and includes the day the item is returned to Colour You Beautiful.

This should be taken into consideration by the customer when placing the order.

 

Late fees:

If for any reason the customer does not return the item(s) on the return date, late fees may apply. A grace period may be allowed depending on the effects of future rentals of the item(s). If your late return effects the future rental then late fees will certainly be enforced at 50% of the rental per day. This charges will be applicable up until either the item is returned without damage to the business or up until a time in which the business has charged the customer an amount equivalent to 200% Recommended Retail Price (RRP) of the item(s). By renting an item through Colour You Beautiful you accept this agreement and therefore give permission for Colour You Beautiful to charge fees for late returns of any and all items rented, this charge will be made from the original payment method used when placing the rental. You will be given the option of using an alternative payment method before the charge is made.

Customer cancellations / Store credit:

Full refunds will be given if;

  • Cancellations are made within the first 24 hours of ordering (unless the item has already been dispatched to you)
  • Cancellations requested 3 days prior to your booking date


Colour You Beautiful will not, at any time, offer refunds for any item(s) hired for a hire period outside of the above. All applicable clients will instead be offered a store credit / voucher to the value of the item’s hire period, at the discretion of the business.

In the instance where the hire price is more than the value of the store credit / voucher, the difference in value is payable by the client and in the reverse, if the hire price is less than the value of the store credit / voucher, the customer forfeits any additional credit included in the original value.

We at Colour You Beautiful understand sometimes unexpected things happen and in exceptional circumstances we will consider a cancellation outside of the above, however we reserve the right to decide. Please don’t hesitate to get in touch to explain your situation.

 

Return of HIRE item(s):

Orders placed as “pick up” will be picked up in a box or dress/suit bag. When returning the item(s) to Colour You Beautiful we ask that you place the item(s) back inside the box and/or dress/suit bag, this not only helps us stay environmentally conscious by recycling the parcel box but helps us take care of the items when in transit.

If the parcel box is lost a fee may be charged, however we do ask that the item(s) are places into a new box or bag to protect the item until it is returned to the Colour You Beautiful studio.

 Orders placed as “delivery” will be delivered in a box or dress/suit bag. When returning the item(s) to Colour You Beautiful we ask that you place the item(s) back inside the box and/or dress/suit bag, this not only helps us stay environmentally conscious by recycling the parcel box but helps us take care of the items when in transit.

If the parcel box is lost a fee may be charged, however we do ask that the item(s) are places into a new box or bag to protect the item until it is returned to the Colour You Beautiful studio.

Orders placed as “express shipping” will be shipped in a satchel with a prepaid return satchel inside.

If the prepaid satchel is lost a new satchel is required to be purchased at the expense of the customer in order to return the item to Colour You Beautiful.

Returns for SALE item(s): 

Customers have 14 days from the date of purchase to return the item to the store in a as new condition, at the discretion of the Colour You Beautiful team. If these items were shipped to the customer, the return shipping is at the customers expense. 

*for hygiene shape wear sold through the Colour You Beautiful website or store will not be accepted as a return. 

Returns for PRELOVED item(s):

There are no returns for PreLoved items. PreLoved items are final sale items and will not be accepted as a return. 

 

Cancellations by Colour You Beautiful:

Colour You Beautiful may cancel your booking for any reason. The compensation to you will be limited to the amount you paid to Colour You Beautiful for the booking and the postage. Colour You Beautiful will not take responsibility for any consequential damages that result from the cancellation of the booking.

Reasons Colour You Beautiful may cancel an order include but are not limited to:

- The item(s) you have booked were damaged by a customer that rented the item(s) prior to you.

- The item(s) you have booked were lost or stolen by a customer that rented the item(s) prior to you.

- Due to unforeseen circumstances it is deemed that it is not possible to deliver the item(s) to you in time for your booking, due to previous late return from a customer prior to you, or for any reason, such as postage delays (particularly COVID-19 restrictions)

 

Limitation of Liability:

By placing an order through Colour You Beautiful you accept this rental agreement and you agree that Colour You Beautiful will not be liable for any loss, damage, costs or expenses of an indirect consequential nature incurred or suffered by you as a result of:

Cancellation of a rental booking

Late delivery of a rental item

Non-delivery of a rental item

An issue with the quality of a delivered rental item

This includes but not limited to economic loss, loss of goodwill, emotional suffering, loss of opportunity or other loss of turnover, profits or business.

Colour You Beautiful’s liability will be limited to any amount paid by the customer to Colour You Beautiful.

 

Instagram Promotions:

Any promotion tagging @colour.you.beautiful is limited to one per hire order.

 

Covid-19 POLICY:

In the unfortunate situation that your event is affected by covid-19 due to lockdown or restrictions you will be eligible for a credit note to use on any item through the Colour You Beautiful website or instore.

 

Colour You Beautiful reserves the right to make any changes to the terms and conditions from time to time, without notice, including the hire price of items.
